Statutory Mechanical Royalty Rate History and Current Figures

For 67 years the statutory mechanical royalty rate in the United States was two cents per song. One figure, written into the Copyright Act of 1909, covered every copy of a composition sold in the country, and Congress left it alone until 1976. Nothing about the rate works that simply now. Mechanical rates are reset in multi-year proceedings at the Copyright Royalty Board, they are calculated one way for physical copies and permanent downloads and a completely different way for interactive streams, and they are collected by different organizations depending on the format.

That turns one question into three: what the rate currently is, which formula applies to a specific release, and whether the money calculated under that formula actually reaches the songwriter. The last one is where most of the loss happens, because a mechanical royalty can be calculated correctly, reported on time, and still sit undelivered when the underlying song registration is wrong or missing.

Statutory Mechanical Royalty Rate History Since 1909

The compulsory mechanical license came first, and the rate came with it. The Copyright Act of 1909 established that once a songwriter allowed a composition to be recorded and distributed, other recording artists could record their own version without negotiating permission, provided they complied with the license and paid the rate Congress had set. That rate was two cents per song, per copy. The structure fixed the price of a song in law rather than leaving it to each negotiation, which is the single most important thing to understand about mechanicals: the amount was never really a market number.

What is remarkable is how long the figure survived. Two cents per song carried through the entire recorded music era that followed, from shellac to vinyl, through the LP and the 45, magnetic tape, the eight track and the cassette. Royalty Exchange puts the stretch plainly: That rate held for 67 years, until the Copyright Act of 1976 raised it to 2.75 cents.

A fixed cent figure behaves very differently depending on when you look at it. Two cents in 1909 and two cents in 1975 are the same number on paper and nothing like the same money, so the practical value of the compulsory license to songwriters eroded in every year that prices rose and the statute stayed still. The 1976 increase to 2.75 cents was a correction to a rate that had spent decades falling behind in real terms, not a routine adjustment.

The contrast with the current system is the useful part of this history. Mechanical rates are no longer a number that sits untouched for generations. They are set for defined multi-year periods through Copyright Royalty Board proceedings, revisited on a schedule, and argued hard by the parties with money at stake, which means the rate in effect for a release in one period is not automatically the rate in effect for the next. The practical consequence for anyone researching this topic is that a rate figure without its effective period is incomplete information. Read the period alongside the number, every time.

How the Copyright Royalty Board Sets Mechanical Rates

The Copyright Royalty Board sets the statutory mechanical rate in periodic proceedings, each covering a fixed block of years. The streaming era proceedings are known by number, and Phonorecords IV governs mechanical rates for the 2023 through 2027 period. Rates are not negotiated case by case under this system. They are argued, decided and published for the term, and they bind every licensee operating under the statutory license during that term, whether or not that licensee took part in the proceeding. This is why a current figure always carries a date range with it, and why a rate quoted in an older explainer can be perfectly accurate for its period and wrong for yours.

The other half of the modern system is administrative rather than numeric. The Music Modernization Act of 2018 created the Mechanical Licensing Collective, the entity that administers the blanket mechanical license for interactive streaming in the United States. Rather than a digital service clearing compositions one at a time, a qualifying service operates under a single blanket license and reports its usage to the collective, which matches that usage against song registration data and pays the rights holders it can identify.

The MLC began operations in January 2021, and the scale it reached is the clearest measure of how much mechanical money now runs through one pipe. Royalty Exchange reports: Since it began in January 2021, the MLC has paid out more than $3 billion in mechanical royalties. Membership has passed 68,000 and the database covers more than 50 million songs, according to the same source.

Two consequences follow for a working songwriter. The rate is decided somewhere you are not, on a cycle that has nothing to do with your release schedule, so treat it as a given rather than a variable you manage. What you do control is whether your songs are registered accurately in the database the collective matches against, because the statutory rate is applied to reported usage, and usage only converts into a payment for the writers the registration data identifies.

Mechanical Rate Structure by Distribution Format

One statutory license, two calculation methods. A physical copy or a permanent download generates a mechanical royalty as a fixed per-unit amount multiplied by units distributed. An interactive stream generates one through a revenue-based formula under the blanket license the MLC administers, where the payable amount derives from a service's revenue and usage rather than from a set price per play. Both methods trace back to the same Copyright Royalty Board authority, but the arithmetic, the reporting obligation and the organization holding the money all differ. The format a release ships in decides the rest.

Physical and Permanent Download Rate Calculations

The per-unit calculation has two branches, split by playing time. A song of five minutes or less earns the flat per-song statutory rate on each unit. A song running longer than five minutes is calculated instead on a per-minute statutory figure applied to its playing time. That is why the two cases appear separately in Harry Fox Agency's rate documentation, and why an extended track can earn a materially higher mechanical per copy than a three minute one.

The arithmetic itself is straightforward: units distributed in the period, multiplied by the applicable rate, calculated per song. For an album it runs track by track rather than as a single album level figure, and the five minute test applies to each track independently, so a record with two long cuts and nine short ones produces two different calculations inside the same release.

The obligation sits with the label. Curve's guidance on the reporting chain is explicit that calculating and reporting these royalties against the statutory rate, for downloads in the United States and physical copies manufactured in the United States, is the label's responsibility rather than the retailer's or the songwriter's. For a self-released artist who is also the label, both roles land on the same person. The mechanical license still has to be obtained and the royalty still has to be reported, even when the writer, the recording artist and the label are one individual paying themselves.

The specific current cent figure and the current per-minute figure are not static, and they are not safe to carry over from a prior period. Both are set by the Copyright Royalty Board and adjusted through its proceedings, so the correct move before you calculate anything is to pull the figure directly from the Copyright Royalty Board's published rate order on copyright.gov or from the Mechanical Licensing Collective's rate resource at themlc.com/rates, and to note the period that figure covers. If a release spans a rate change, units distributed on either side of the change can fall under different figures. Any number you find quoted without its effective period should be treated as unverified until you match it to a published order.

Two further details are worth confirming in the order itself rather than assuming: how playing time is counted for the per-minute branch, and whether the rate attaches to units manufactured, units distributed or units sold. The base you multiply against changes the total, and on a large physical run the difference is not trivial.

Interactive Streaming Uses a Revenue-Based Mechanical Formula

There is no statutory cent figure per stream, and hunting for one is the most common wrong turn in this topic. Interactive streaming mechanicals are collected under the blanket license the MLC administers, and the payable amount comes out of a formula built from a service's revenue and other inputs set in the current Copyright Royalty Board proceeding, not from a posted price per play. Phonorecords IV establishes that structure for the 2023 through 2027 period.

The practical difference from the physical calculation is timing and predictability. A per-unit rate lets you multiply and know the answer in advance. A revenue-based formula produces a per-stream value only after the fact, as an output. A service's revenue for the period, the size of the royalty pool the formula generates and the total volume of qualifying streams across that service all move the result, so the effective per-stream mechanical on the same song can differ between two months on the same platform and between two platforms in the same month. That is also why a revenue breakdown by DSP tells a songwriter more about their streaming income than any average per-stream number will.

The percentages, the greater of and lesser of elements, and the weights inside the formula belong to the current rate order, and the general structure described here is not a substitute for them. If you need the operative figures, read them from the Copyright Royalty Board determination covering the current period or from the MLC's published rate resource, then check that the release you are calculating actually falls inside that period.

What reaches the writer at the end of it is a payment from the MLC, calculated on matched usage and distributed to the rights holders the registration data identifies. The formula decides the size of the pool. The registration decides whose share it is.

Reporting and Collection Paths for Mechanical Royalties

The collection path splits the same way the calculation does. Interactive streaming mechanicals are collected and distributed by the MLC. Mechanicals on physical copies and permanent downloads move through the Harry Fox Agency or through direct reporting to the publisher, an older and more manual chain in which licenses are obtained per composition and statements are filed on a set schedule.

The territorial rules are where labels most often misread their obligation, and they are clearer stated as conditions:

A label based outside the United States must report United States mechanical royalties on downloads in the United States.
A United States label does not need to report mechanicals on permanent downloads outside the United States, because those sales fall under the download stores' own mechanical licenses.
A United States label reports mechanicals on physical copies manufactured and distributed in the United States.
An overseas label reports mechanicals on physical units imported into and distributed in the United States.

The common thread in Curve's guidance on these cases is that the obligation follows the territory of the sale or distribution rather than the address of the company. It matters most to artists working across borders, where a release can create a United States reporting duty for a label that has never operated here, and where an assumption in the other direction leaves a statement unfiled for years.

Reporting to HFA runs quarterly, and the calculation is the one described above: units sold within the quarter, multiplied by the statutory rate. The publisher then distributes what it collects to its songwriters according to the terms of their individual contracts. That handoff is the point where a published statutory figure stops being the number that matters and the contract takes over.

Quarterly cycles also explain a timing question that comes up constantly among writers with active catalogs. A sale or a stream in January is captured in a quarterly statement, processed by the collecting organization, then passed through a publisher before it becomes money in an account, so how long it takes to receive music royalties is mostly a function of how many handoffs sit in the chain rather than of when the play happened. More handoffs means later payment. Unresolved registrations can mean no payment at all until the data is corrected.

For a writer with credits spread across several labels and distributors, this is less a matter of one payment running late than of several separate pipelines operating on their own schedules, with different reporting parties, different collectors and different failure points. Producers and co-writers feel it most, because every credit is its own chain and any one of them can break without the others showing a symptom.

Controlled Composition Clauses Cut Songwriters' Statutory Payments

A controlled composition clause is a provision in a recording contract under which the songwriter, usually also the recording artist, agrees that the label may pay less than the full statutory mechanical rate on songs that artist wrote or co-wrote. It is lawful, it is standard in traditional label deals, and it is the main reason the rate published through Copyright Royalty Board proceedings and the rate an individual writer actually receives can be two different numbers. The clause does not change the statutory rate. It changes what the label is contractually obligated to pay against it, usually through one of three mechanisms that often appear together in the same agreement.

Minimum Rate Floors in Controlled Composition Clauses

A minimum statutory rate provision pins the mechanical rate a label will pay to a fixed contractual reference instead of letting it track the statutory figure over time. Later increases from Copyright Royalty Board proceedings do not automatically flow through to those songs. On a catalog that keeps selling or streaming for years after the deal was signed, the gap between the contract rate and the current statutory rate widens with every rate period that passes.

Per-Album Track Caps on Mechanical Payments

A track cap limits the total mechanical royalties payable on an album to a fixed number of songs, regardless of how many tracks the album actually contains. If the cap is ten songs and the album ships sixteen, the same capped pool of mechanicals is spread across all sixteen, and the effective per-song rate drops well below the statutory figure. Long records, deluxe editions and reissues with bonus material take the heaviest reduction.

Paying a Reduced Percentage of the Statutory Rate

The third mechanism pays a set percentage, commonly below 100 percent, of either the full statutory rate or of an already reduced negotiated rate. On its own it is simple multiplication. Combined with a track cap or a fixed rate reference it compounds, and a reduced percentage of a rate frozen at an earlier period, divided across a capped track count, can land far under the statutory baseline quoted publicly. Reading any one clause in isolation understates the total reduction.

Confirming the Mechanical Rate Applied to Your Catalog

There is no single flat figure to look up and apply across everything you have released. The rate governing a specific recording depends on the format it was distributed in, the rate period that distribution falls under, and whatever the recording or publishing contract says about controlled compositions. Confirming it means reading three things together: the current Copyright Royalty Board rate order or the MLC rate resource for the statutory figure and its effective period, your distribution reporting for the format and unit counts, and the contract itself for any provision that reduces what is payable to you.

Getting the rate right is only half the problem. A correctly calculated mechanical royalty still has to find you, and that depends on registration. Streaming mechanicals are matched and paid by the MLC against its song registration data, so a work missing from that database, or registered with an incorrect writer split or mismatched recording identifiers, can generate royalties computed correctly under the statutory formula that never reach the writer. For physical copies and permanent downloads, the equivalent question is whether HFA or a publishing administrator actually represents the composition in the first place.

Worth checking across your own catalog: whether every song you wrote or co-wrote appears in the MLC database with accurate splits, whether releases from before January 2021 were carried over, whether a co-writer's publisher registered a work you assumed someone else was handling, and whether releases under an alternate artist name or a misspelled writer credit are matching at all. Registration gaps of that kind are what turn a valid statutory entitlement into unclaimed music royalties sitting with a collective.

That is the work Mogul does with artists and songwriters: looking for royalties that may not have reached them, fixing registration gaps with PROs, the MLC and SoundExchange, and helping them keep more of what they earn. Checking registrations is not a guarantee of payment, and no one can tell you in advance what a corrected registration will return. What it does is narrow the distance between the rate the statute sets and the money that actually arrives, which is the only part of this system a songwriter can move.
